Draft v0.1 · pending attorney review

ShipMova Referral Program Terms

Draft v0.1 · prepared 2026-10-14 · not yet reviewed by a licensed attorney — do not rely on this as final.

> For the attorney. This is the published version of the rules in the "Referral program" section Buyers, Sellers, Shippers and Inspectors see linked from the homepage and their dashboard. It sits alongside the Terms & Conditions and the Seller Terms (§13), which refer to this page rather than repeating it.

1. Who can refer, and who they can refer

Anyone with a ShipMova account — Buyer, Seller, Shipper or Inspector — gets their own referral link and may refer anyone: a Buyer may refer a Seller, a Shipper may refer a Buyer, and so on. There is no requirement that the person you refer hold the same kind of account as you.

2. What earns you $100

You earn $100, once, for each person you refer, the first time that person completes:

  • Buyer — buys a car through a completed Escrow.com deal;
  • Seller — sells a car through a completed Escrow.com deal;
  • Shipper — completes their first shipment;
  • Inspector — completes their first *paid* inspection (passing alone isn't enough; it has to be paid).

Each referred person can earn you $100 only once, no matter which of the above they end up doing, and only for the first one they complete.

3. How and when you're paid

Referral earnings accrue as you go, but ShipMova pays out in blocks of 10: once 10 of the people you referred have each completed their first transaction, you're paid $1,000. Earnings below 10 show as pending in your dashboard, not as a smaller cash payout — there's no partial payout for 1 through 9 referrals in a block.

There's no cap: refer 20 people and you're paid twice; refer 100 and you're paid ten times.

4. Anti-fraud

A referral is not credited, and earns nothing, if ShipMova's checks find that the same email alias, phone number, device or IP address connects you and the person you referred — this is treated as a self-referral, whether or not that was the intent. ShipMova may also flag an unusually high rate of referrals from one account for manual review before paying it out; a flag holds the payout, it doesn't cancel it.

5. Changes

ShipMova may update these Referral Program Terms, including the $100/$1,000/10 figures. A change applies to referrals credited after the change; it never reduces or cancels an amount already earned under the rules in force at the time.

6. Questions for the attorney

  1. Is a cash referral reward like this subject to any state's referral/MLM or gift-card-adjacent regulation at this size ($100/$1,000), and does it need different treatment for a Nigeria/Ghana/Togo/Benin-resident referrer versus a US-resident one?
  2. 1099 / tax-reporting obligations for referral payouts (mirrors the open question in the Seller Terms about Seller proceeds) — lib/referral-credit.ts already tracks these per referrer per year (referral_annual_payouts) for this purpose.
  3. Whether this page needs its own click-to-accept (like the Terms & Conditions do) before a referral link can be generated, or whether linking it from the dashboard/homepage is enough.
